1. Introduction
This Privacy Policy (hereinafter referred to as the "Policy") explains how Maler Software S.R.L. (hereinafter "Zippy", "We", "Us", or "Our"), a limited liability company organized and existing under the laws of the Republic of Moldova, collects, uses, shares, and protects information in relation to Our Zippy file versioning and backup software (the "Software"), as defined in Our Terms of Use. This Policy also describes Your choices regarding the collection and use of Your information.
This Policy applies to information We process through the Software and in connection with Your license purchase and support interactions. It is crucial to understand that this Policy does not apply to the content, files, data, notes, or any other information that You create, store, manage, or back up using the Software on Your local computer ("User Content"). As detailed herein and in Our Terms of Use, all User Content is stored locally on Your computer and is not accessed, collected, or transmitted by Zippy.
By downloading, installing, accessing, or using the Software, or by purchasing a license for the Software, You signify Your agreement to the terms of this Privacy Policy. This Policy forms an integral part of Our legal agreement with You, which also includes Our Terms of Use, Refund Policy, and Third-Party Licenses documentation. 3. Information we collect
We collect specific types of information in connection with the provision and use of the Software. We are committed to collecting only the information necessary for the purposes outlined in this Policy.
3.1 Information collected automatically through the software
(a) License Activation and Deactivation Data: When You activate a Licensed Version of the Software, We collect Your license key and the IP address of the computer performing the activation. When You deactivate a license, We collect Your license key, a unique instance identifier for the installation, and the IP address. This information is essential for Us to: (i) Validate Your license and ensure its authenticity. (ii) Manage and enforce the number of active installations permitted under Your purchased license tier. (iii) Prevent fraudulent use of licenses. (iv) Provide You with access to the features corresponding to Your Licensed Version.
Additionally, to maintain license validity during a subscription term, We perform a periodic validation check that collects the license key and IP address.
(b) Anonymous Installation Tracking: Upon the installation or uninstallation of the Software, We collect an anonymous, non-personally identifiable event marker. This data is used exclusively for statistical purposes to track the total number of installations and uninstallations. It contains no personal information, system details, hardware specifications, or any other data that could identify You or Your specific device.
3.2 Information related to your purchase
When You purchase a license for the Software, the transaction is processed by Our third-party payment processor, PayPro Global (the "Payment Processor"), acting as the Merchant of Record. The Payment Processor collects information necessary to complete Your transaction, which may include Your name, email address, billing address, and payment details (e.g., credit card information). Zippy does not directly collect, store, or have access to Your sensitive payment details, such as full credit card numbers.
We receive confirmation of Your purchase from the Payment Processor. This confirmation typically includes: (a) Your name and email address. (b) The license key issued to You. (c) The license tier You purchased. (d) The date and amount of the transaction.
We use this purchase-related information to fulfill Your order, deliver Your license key, provide customer support related to Your purchase, manage Your license status, and for Our internal accounting and record-keeping purposes.
3.3 Information you provide directly to us
(a) Support Communications: If You contact Us for technical support, to report a bug, or for any other inquiry (e.g., via the contact form on Our website), We will collect the information You provide in Your correspondence. This may include Your name, email address, license key (if applicable), and details about Your query or issue. We use this information solely to respond to Your inquiry, provide assistance, and improve Our Software and support services.
(b) User-Submitted Feedback: Any information, suggestions, or feedback voluntarily provided by You through any feature within the Software (such as a "Report a bug" option, if available) or directly to Us, concerning the Software's functionality, features, or performance, becomes the exclusive property of Maler Software S.R.L.. Such submissions are made without any expectation of compensation or attribution. We may use this feedback at Our sole discretion for product improvement, troubleshooting, development, or any other lawful business purpose.
3.4 Information stored locally by the software (not collected by Zippy)
The primary function of the Software is to create versioned backups of Your User Content. All User Content, including Your project files, the backup versions created by the Software, any notes You associate with these versions, Software configuration settings (such as exclusion patterns), and the Software's internal database (e.g., zippy.db
), are stored exclusively on Your local computer's hard drive within the designated project and backup folders You establish.
Zippy does not, under any circumstances, access, collect, monitor, or transmit Your User Content or the contents of Your local backup files. You are solely responsible for the security, management, and confidentiality of all data stored locally on Your computer, including User Content managed by the Software.
4. How we use your information
We use the information We collect for the following specific purposes:
(a) To provide, operate, maintain, secure, and improve the Software and Our services. (b) To process Your transactions for license purchases and deliver Your purchased license key(s). (c) To validate Your license during activation and periodically during the subscription term, and to manage the number of permitted activations in accordance with Your purchased subscription plan. (d) To prevent fraudulent transactions and ensure the security of Our Software and licensing systems. (e) To respond to Your support requests, questions, feedback, and provide customer service. (f) To communicate with You regarding Your license, important Software updates (as defined in the Terms of Use), security alerts, or significant changes to this Privacy Policy, Our Terms of Use, Refund Policy, or Third-Party Licenses. (g) To enforce Our Terms of Use and to comply with applicable legal obligations, court orders, or governmental regulations. (h) For internal administrative purposes, such as auditing, data analysis for installation trends (using anonymous data only), and research to improve Our Software.

This includes providing You with the Licensed Version of the Software and managing Your license.
(b) Legitimate Interests: We may process certain information based on Our legitimate interests, provided these interests are not overridden by Your data protection interests or fundamental rights and freedoms. Our legitimate interests include: (i) Fraud prevention and security of Our licensing systems. (iii) Responding to Your inquiries and providing effective customer support. (iv) Informing You of critical updates or security issues related to the Software.

If We ask You to provide personal information to comply with a legal requirement or to perform a contract with You, We will make this clear at the relevant time and advise You whether the provision of Your personal information is mandatory or not (as well as of the possible consequences if You do not provide Your personal information).
6. Data sharing and disclosure
We do not sell, rent, or trade Your personal information to third parties for their marketing purposes. We may share Your personal information only in the following limited circumstances:
(a) Payment Processor: As stated in Section 3.2, We share necessary purchase information with Our Payment Processor, PayPro Global, to enable them to process Your payments. The Payment Processor's use of Your information is governed by their own privacy policy and terms of service.
(b) Service Providers: We may employ third-party companies and individuals to facilitate Our services or provide services on Our behalf (e.g., license server hosting, email delivery services for transactional emails, customer support platforms). These third parties are authorized to access Your personal information only to perform these specific tasks on Our behalf and are contractually obligated not to disclose or use it for any other purpose.
(c) Legal Requirements and Protection of Rights: We may disclose Your information if We believe in good faith that such disclosure is necessary to: (i) Comply with a legal obligation, applicable law, regulation, or valid legal process (such as a subpoena or court order). (ii) Protect and defend the rights, property, or safety of Maler Software S.R.L., Our users, or the public. (iii) Investigate, prevent, or take action regarding illegal activities, suspected fraud, or situations involving potential threats to the safety of any person. (iv) Enforce Our Terms of Use or other agreements.
(d) Business Transfers: If Maler Software S.R.L. is involved in a merger, acquisition, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, Your personal information held by Us may be among the assets transferred. We will provide notice (e.g., via email and/or a prominent notice on Our website) before Your personal information is transferred and becomes subject to a different privacy policy.
(e) Aggregated or Anonymized Data: We may share aggregated or anonymized information (such as anonymous installation statistics) that does not directly identify You with third parties for research, analysis, or other purposes.
7. Data security
We implement reasonable and appropriate administrative, technical, and physical security measures designed to protect the personal information We collect from loss, misuse, unauthorized access, disclosure, alteration, and destruction. These measures include, for example, encryption of data in transit where appropriate and access controls to Our systems.
However, please be aware that no security measures are perfect or impenetrable, and We cannot guarantee the absolute security of Your information transmitted to or stored on Our servers. The transmission of information via the internet is not completely secure. Any transmission of personal information is at Your own risk. You are also responsible for maintaining the security of Your license key and for ensuring the security of the data (including User Content) stored locally on Your computer.
8. Data retention
We will retain Your personal information only for as long as is necessary for the purposes set out in this Privacy Policy, unless a longer retention period is required or permitted by applicable law. The criteria used to determine Our retention periods include:
(a) License Validity: License activation and deactivation data is retained for as long as Your license is considered active and for a reasonable period thereafter as may be required for auditing purposes, to resolve disputes, enforce Our agreements, and comply with legal obligations. (b) Legal and Regulatory Requirements: Purchase information (excluding sensitive payment details) may be retained for periods required by accounting, tax, and other applicable laws and regulations. (d) Business Needs: We may retain certain information for legitimate business needs, such as for enforcing Our Terms of Use or preventing fraud, provided such retention is consistent with applicable law.
When We no longer have a legitimate business need to process Your personal information, We will either delete or anonymize it, or, if this is not possible (for example, because Your personal information has been stored in backup archives), then We will securely store Your personal information and isolate it from any further processing until deletion is possible.

To exercise any of these rights, please contact Us using the contact form available at zippy.zip/contact
. We will respond to Your request in accordance with applicable data protection laws.
